Terms of Use and Privacy Policy

HEYEYE.CO.IL (hereinafter “the Site”) is the responsibility of licensed dealer HEYEYE, Business ID: 558575197 (hereinafter “Site Management” or “the Company”).

The Site serves as a brand website that offers, inter alia, for sale optical glasses, sunglasses, contact lenses, and jewelry (hereinafter: “the Products”).

1. General: The provisions in these terms refer equally to both genders, and the use of masculine language is for convenience only.
2. The provisions of these terms and the conditions of use appearing on the Site define the content and commitment of HEYEYE between the Site’s users and the Company.
3. The Company may, at any time, at its sole discretion, update these terms.
4. These terms apply to the use of the Site and the services included therein through any computer or other communication device (such as cellular phones, tablets, etc.). They also apply to the use of the Site, whether via the Internet or through any other network or means of communication.
5. Nothing in these terms shall derogate from the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: “Consumer Protection Law”) and the regulations enacted thereunder, insofar as they apply to the Site (hereinafter: “the Provisions”), except in cases where it is permissible to stipulate on such provisions and such stipulation was made within the framework of the Site, either explicitly or implicitly.
6. The Company and Site Management make their best efforts to present the most complete and comprehensive information regarding the products and services provided, including images. Notwithstanding the provisions of this section, it is clarified that inaccuracies and/or errors and/or omissions may appear on the Site in good faith and without malicious intent and/or desire to mislead, and the Company, Site Management, and the Site shall not bear any responsibility arising from such inaccuracies or errors.
7. Chapter headings are provided for the convenience and orientation of the customer and shall not be used in the interpretation of the terms.
8. Typographical errors in the description of product(s) shall not bind the Company.
9. Product images on the Site are for illustration purposes only.
10. It is prohibited to copy and use, or allow others to use, in any other way, content from the Site, including on other websites, in electronic publications, print publications, etc., for any other purpose.
11. The date recorded, for any matter and purpose, in the Company’s computers is the determining date for all matters.
12. Filling out forms and requesting service or information from the Company does not obligate the Site and/or the Company.
13. At this stage, the Site does not offer the option to make online purchases, and all information appearing on the Site is informative and does not bind the Company regarding its update and accuracy.
14. The Site does not collect “cookie” data on customers and therefore does not require their use.
15. Copyright a. All intellectual property rights, including patents, graphic designs, trademarks, copyrights, designs, models, and trade secrets, are the sole property of the Company or of other third parties who have authorized Site Management to use them. b. These rights apply, inter alia, to the data on the Site, including the list of products, description and design of products, and any other detail related to its operation. c. These rights also apply to the name of the Site and the domain name (www.heyeye.co.il) of the Site; the trademarks (whether registered or not) are all property of the Company. They may not be used without obtaining its written consent in advance. d. It is prohibited to copy, duplicate, distribute, sell, market, rent, and translate any information from the Site, including trademarks, images and texts, product designs, product images, etc., without obtaining prior written approval from the Company. e. It is prohibited to link to content from the Site that is not the Site’s homepage (deep linking) and it is prohibited to display or publish such content in any way, unless the deep link is to the web page on the Site in full and as it is, so that it can be viewed and used in a manner identical to its use and viewing on the Site, and this is subject to obtaining consent from Site Management.
16. Liability a. The Company (and/or anyone on its behalf) does not bear direct and/or indirect liability for damages arising from and/or related in any way to the repair, assembly, and/or replacement of the Products. b. The Company (and/or anyone on its behalf) does not bear direct or indirect liability for damages resulting from the use of and/or reliance on information published on external sites, which can be accessed through any of the services on the Site. It is clarified that the Company does and will do its best to cooperate only with reliable and reputable suppliers. c. The Company (and/or anyone on its behalf) does not bear direct and/or indirect liability for damages arising from and/or related in any way to the use and/or performance of the Site. d. In any case, the Company shall not be liable for any activity of any other entity not under its full control.
17. Law and Jurisdiction a. The law applicable to these terms and/or to any action and/or dispute arising from it is Israeli law only. b. In any case of dispute, the courts (Magistrate’s or District) of Tel Aviv-Jaffa shall have exclusive jurisdiction to hear it. c. The law applicable to the use of the Site, to the order, and to these terms, including the interpretation and enforcement of the terms, is Israeli law only.
